Like all states in the country, Idaho celebrates holidays that are recognized by the federal government. It is often confusing to employees whether an employer is required to give them paid time off or pay a higher rate when they work on a holiday. All holiday laws in Idaho are overseen by the Idaho Department of Labor.
Under Idaho law, employers are not required to provide employees with paid holidays. In addition, employers are not required to pay an employee a higher rate of pay if they are required to work on a holiday. Employees may receive overtime pay if they work on a holiday and accrue more than 40 hours in the same week. However, many employers in Idaho offer paid holidays to employees as a benefit even though it is not required under the law.
All federal holidays including Columbus Day, Veteran’s Day and Independence Day are recognized in Idaho. If the holiday falls on a weekend, it may be celebrated on either Friday or Monday. State employees are entitled to paid days off on holidays. State employees whose jobs fall under public health or safety who are required to work on a holiday may take an alternative day off as the holiday but may not receive additional compensation.
On January 16, Idaho celebrates Idaho Human Rights Day in recognition of the struggle for human rights in the state. Like other states, Idaho struggled with prejudice and influences from segregationist groups like the Ku Klux Klan. In an effort to demonstrate the state’s efforts to promote human rights, the state legislature created Idaho Human Rights Day. Each year, the state celebrates the holiday on the same day that the rest of the country celebrates Dr. Martin Luther King, Jr. Day on the third Monday in January.
Idaho, like many states, does not guarantee employees paid holidays although most employers in the state do provide paid holidays as a benefit to employees. In addition, the state grants the governor the authority to designate other holidays as necessary.
